Terms of Service

These Terms set out the rules of using EduPlux. They're a contract between your institution (or you, if you signed up personally) and EduPlux Technologies Pvt. Ltd. We've done our best to keep them readable.

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the EduPlux platform, websites, and mobile applications (the “Service”), provided by EduPlux Technologies Pvt. Ltd. (“EduPlux”, “we”, “us”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you are accepting these Terms on behalf of an institution, you confirm you have authority to bind that institution.

2. Eligibility & Accounts

You must be at least 18 years old to create an institution account. Student and parent accounts are provisioned by the institution. You are responsible for safeguarding your password and for any activity under your account. Notify us immediately at security@eduplux.in if you suspect unauthorized access.

3. Subscriptions & Fees

Paid plans are billed in advance on a monthly or annual basis. Fees are quoted exclusive of GST. Unless cancelled, subscriptions automatically renew at the end of each billing cycle.

  • Free trial: 14 days, no credit card required.
  • Refunds: available on a pro-rata basis within 30 days of an annual renewal if you have not used the renewed period.
  • Late payment: accounts unpaid for more than 30 days may be suspended; data is retained per Section 9.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate the rights of others.
  • Upload malware, attempt to bypass authentication, or probe the system for vulnerabilities without written permission.
  • Resell, sublicense or white-label the Service without a written reseller agreement.
  • Use the Service to send unsolicited bulk communications.

5. Customer Data & Privacy

You retain ownership of all data you upload (“Customer Data”). You grant EduPlux a limited license to host, copy, transmit and display Customer Data solely as needed to provide the Service. Our handling of personal data is described in our Privacy Policy.

6. Intellectual Property

EduPlux retains all right, title and interest in the Service, including all software, designs, trademarks, logos, and documentation. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription. You may not copy, modify, reverse-engineer or create derivative works of the Service.

7. Service Level Commitment

EduPlux targets 99.9% monthly uptime for the production Service, excluding scheduled maintenance announced at least 48 hours in advance. Customers on the Enterprise plan are eligible for service credits as described in their order form.

8. Suspension & Termination

You may cancel your subscription at any time from your dashboard or by emailing billing@eduplux.in. We may suspend or terminate the Service if you materially breach these Terms, fail to pay, or use the Service in a way that endangers other users or our infrastructure.

9. Data Export & Deletion

At any time during your subscription, you may export Customer Data in CSV or JSON via the dashboard. After termination, we retain Customer Data for 90 days to enable export, then permanently delete it — unless retention is required by law.

10. Disclaimers

The Service is provided “as is” and “as available”. EduPlux disclaims all warranties not expressly stated in these Terms, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, EduPlux's aggregate liability arising out of or relating to these Terms will not exceed the fees paid by you to EduPlux in the 12 months preceding the claim. EduPlux will not be liable for indirect, incidental, special or consequential damages.

12. Indemnification

You will indemnify EduPlux against any third-party claim arising from your Customer Data, your use of the Service in violation of these Terms, or your violation of any law.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts at Bangalore, Karnataka.

14. Changes to Terms

We may revise these Terms from time to time. Material changes will be announced by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
